PRIVACY POLICY

1975 d.o.o., having its registered address at Šentrupert 8, 3303 Gomilsko, Slovenia (hereinafter referred to “Just A Corpse”, “provider”, “data controller”, “we” or “us”) respects the privacy of its users (hereinafter referred to as “you” or “user”). We believe that is important for you to make informed decisions regarding the use of our website based on your understanding of what information we collect through the use of our website, what we do with such information, how we process it, with whom do we share it, as well as your rights and choices regarding your information processed by us. Therefore, we have provided this privacy policy (hereinafter referred to as “Privacy Policy”), which further describes our privacy practices while you use our website.  This Privacy Policy is part of and incorporated by reference into the General Terms and Conditions governing your use of https://justacorpse.com/, and any other websites and/or URL address which may replace it or which may be added to the list of the website published by Just A Corpse and linking to this Privacy Policy (hereinafter referred to as “Online Store”).  We recommend that you read this Privacy Policy in full to ensure you are fully informed.  
  1. INFORMATION WE COLLECT FROM YOU
We collect a variety of information as listed below as needed to operate our business and for the legitimate interest of our business, including for marketing purposes, as permitted by applicable legislation.   
LOG DATA: When a user uses or interacts with our Online Store, or clicks on a link that directs the user to our Online Store, the user’s browser automatically provides, and we automatically collect and store, certain information about the user’s device (computer, tablet, smartphone) and the user’s activities:   
  • preference and settings: time zone, language, character size 
  • identifiers: IP address 
  • technical information: type of device, browser information, operating system name and version, screen resolution 
We collect these information for proper operation of our Online Store. Until the user does not place an order or interacts in any other way with our Online Store (for example fills out a form or requests information about our products or services) this data cannot be linked to a specific individual.    TRAFFIC DATA: Data generated by the use of the Online Store also include as follows:
  • information about the use of the Online Store: dates and times of visits, visited pages or URLs, time spent on individual pages, the number of visited pages, total time spent on the website, etc. 
  • data about all the user’s purchases and issued invoices (data and place of purchase, purchased products, prices of purchased products, total purchase value, manner of payment, delivery address, number and date of invoice, etc.) and data about resolving reclamations of products 
We collect these information for proper operation of our Online Store. Until the user does not place an order or interacts in any other way with our Online Store (for example fills out a form or requests information about our products or services) this data cannot be linked to a specific individual.   INTERACTIONS FROM USERS: If a user interacts with us, for example places an order, inquires about our products or services, we collect information provided to us through the order form or inquiry form made available on our Online Store. Such information is provided directly and voluntarily by the user and depending on the circumstances, the information may include:  
  • first name and last name 
  • email address 
  • street address, city, state, country and/or province 
  • telephone number 
  • mobile number 
  • name of the business 
We collect this data for sales purposes (order fulfilment) and to respond to a request from a user so that we may provide information about our products or services.    PAYMENT INFORMATION: When a user pays for the ordered products and/or services, we collect the method of payment, date and amount of the payment. If the user pays with a credit card, this information is transmitted directly to our payment processor, and we do not retain any details of the payment information other than the transaction ID number. After the user has entered payment card information, Just A Corpse does not have access to payment card information and we disclaim any liability for any loss of payment card information. When you make a payment, you agree to the terms and conditions of our payment processor.   
COMMUNICATION FROM USERS: When a user fills out a form or requests information about our products or services or when a user otherwise contacts us, by email, phone or text, we automatically collect and store certain information about that user and user’s activities, as we receive it from such user. For example:  
  • the user’s name and contact information 
  • any information that the user provides to us 
  • the nature of the communication 
  • the purpose of the interaction and the action we took in response to user’s inquiry 
  • any action user takes upon receipt of such communication  
  SOCIAL MEDIA: Our Online Store offers integrations with third-party social media platforms, such as Facebook and Instagram. These services collect your IP address and which page you are visiting on our Online Store. They may send a cookie to enable their features to function properly. Your interactions with such features are governed by the privacy policies of the respective company providing the feature in question. Your use of these features is optional. If you choose to use them, you will be deemed to have expressly consented to the collection of personal data by these companies according to their terms and conditions.    Please note that you are not required by law to provide us with certain personal information. You can always refuse to provide certain personal information, however, you acknowledge that such refusal may prevent you from engaging in certain activities within the Online Store.  In the event we combine personal information with non-personal information, the combined information will be treated as personal information for as long as it remains combined.   
  1. HOW WE COLLECT INFORMATION
Information is collected through various different means, as described below. We collect and process your personal data on the basis of individual’s consent (order of products) or when there is legal basis for the collection of personal data, or we have legitimate interest for such processing of personal data. All personal data you provide to us will be treated confidentially and will only be used for the purpose for which it was provided and collected. 
  • INFORMATION PROVIDED BY YOUR DEVICE: some information is provided automatically by your device or browser (for example device type information, browser information) 
  • DIRECT CONTACT (INTERACTIONS) BY THE USER: some information is provided to us directly by the user (for example if a user is requesting information about our products or services, placing an order, filling out a form) 
  • THIRD PARTIES: some information is provided by third-party providers who have confirmed that they have the right to share such information 
 
  1. USE OF INFORMATION AND DISCLOSURE
We use the information we collect from you for delivering our Online Store and to operate our business.  We use it also for improving our Online Store, for enhancing security and for analytics and research purposes to make sure we provide you with the best experience. In addition, we use your information to promote our products, services and Online Store, for providing customer support and for complying with our legal obligations. 
  • Delivering our services: developing, delivering and improving our products, services, and content, tailoring our products and services, understanding and analyzing trends in connection with usage of the Online Store, administering the Online Store, and customer communications. 
  • Promoting our Online Store, products and services: when you use our Online Store we may promote our Online Store, products and services. 
  • Analytics and research: Understanding and analyzing trends in connection with the usage of Online Store, auditing, learning about user behavior on the Online Store (how often you use the Online Store, the events that occur on the Online Store, aggregated usage, performance data etc.). We also use information collected from pixel tags in marketing emails that we send to you (where we have your consent to do so) to measure open, click through and read rates and allow us to improve our emailing campaigns.

We cannot provide all services necessary for the successful operation of the Online Store by ourselves, therefore we must share collected information with third parties. Except as  described below, Just A Corpse will not share or disclose user’s personal data with third parties.  Please note that we may share information that can be used to personally identify your device (e.g. IP address) for the purposes of delivering our services, promoting our products and services and conducting analysis and research. We also reserve the right to disclose your information (including personally identifiable information) when we are legally required to do so.   We may share such information to: 
  • Analytics providers: We use automated devices and applications, such as Google Analytics, to evaluate use of our Online Store. Analytics service providers use cookies and other tracking technologies to perform their services. For more details, please review our Cookie Policy.  
  • Social media networks: The Online Store may include social media features, such as like, follow and share buttons, provided by third-party social networks such as Facebook and Instagram (“Social Media Features”). These Social Media Features may collect your IP address, which page you are visiting on our Online Store, and may set a cookie to enable the Social Media Feature to function properly. Social Media Features are generally hosted by a third party, but may also be hosted directly on our Online Store. Your interactions with these Social Media Features are governed by the privacy policy of the third party social media network providing it.   • Payment processing: We work with a payment processing company to process credit card payments. In case you make any payments to us, our payment processing company will store on our behalf your full name, address, phone number, email address and credit card details.  
  • Law enforcement: We may have to disclose user information if a court, law enforcement or other public or government authority with appropriate jurisdiction requests that we provide that user’s information, and such request is made using the method required by law in the applicable jurisdiction, such as a search warrant, subpoena, or a court order, and we believe that such request is valid.

  1. THIRD-PARTY SITES AND SERVICES
This Privacy Policy applies solely to the information collected by Just A Corpse through the Online Store and does not apply to any other websites, applications or services. Portions of the Online Store may involve linking to or using third-party services such as various icons, shortcuts, applications or other means of access. Though we make best efforts to review such services and ensure their suitability for children, we have no control over third-party services and all use of such services is at your own risk. We cannot accept responsibility for the privacy practices of any such third-party services  and we are not responsible for content made available by them. Just A Corpse does not endorse any third-party services and we urge you to exercise caution in using them and to review their privacy practices.   
  1. STORING PERSONAL DATA 
The provider will store your personal data only for the time necessary to realize the purpose for which the personal data was collected and further processed (e.g. for the provider’s fulfilment of your orders, checking your payment and fulfilment of other obligations of the provider and/or yours, etc.)  The personal data that are being processed on a legal basis the provider stores for the time period defined by law.  The personal data that are being processed, based on a contract with the individual, the provider stores for the duration of the contract and 5 years after its expiration, unless there has been a dispute about the contract between the user and the provider. In this case, the provider stores such data for 5 years after the finality of the court or arbitrary ruling or settlement or, if there was no judicial dispute, 5 years from the day of amicable settlement.  The provider stores the data that are processed based on personal consent or legitimate interest permanently, until the revocation of such consent or objection to data processing from the user. The provider deletes these data before objection only when the purpose of storing data had already been fulfilled or when defined by law.  After the end of the period of personal data being stored, the data controller effectively and permanently erases or anonymizes the personal data so that they cannot be linked to an individual.   
  1. AGE OF CONSENT
By using the Online Store, you represent that you are at least the age of majority in your state of province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this Online Store.   
  1. YOUR RIGHTS UNDER THE EU GENERAL DATA PROTECTION REGULATION (EEA RESIDENTS)
The GDPR provides you with certain rights with respect to Personal Data that data controllers hold about you, including certain rights to access Personal Data, to request correction of the Personal Data, to request to restrict or delete Personal Data, and to object to our processing of your Personal Data.  Your rights include:  
  • Right to object. You have the right to object to the processing of your personal information that is processed on the grounds of legitimate interests. You are always free to opt-out from the future collection of your personal information by us and our partners by not accessing and/or using the Online Store. 
  • Right of access. You have a right to know what information we hold about you and in some cases to have the information communicated to you. If you wish to exercise this right please contact us by letting us know that you wish to exercise your right to access and what information, in particular, you would like to receive. We reserve the right to ask for reasonable evidence to verify your identity before we provide you with any information. Please note that we may not be able to provide all the information you ask for, for instance, if the information includes personal information about another person. Where we are not able to provide you with the information that you have asked for, we will explain to you why. We will try to respond to any request for a right of access as soon as possible, but we will always do so within 1 month of receipt of your request and verification of your identity. 
  • Right to correct personal information. We try to keep the information that we hold about you accurate and up to date. Should you realize that any of the information that we hold about you is incorrect, please contact us via info@justacorpse.com and we will correct it as soon as we can. 
  • Data deletion. You have a right to request deletion of the personal information that we hold about you. Should you wish to do that, please contact us at info@justacorpse.com. We reserve the right to ask to provide us additional information to verify your identity before we can start processing your request. Once we receive all information we need in order to be able to identify you, we will delete your personal information you requested us to delete as soon as possible, but we will always do so within 1 month of receipt of your request and verification of your identity. Please note that we may still retain some or all of that information, for example for complying with our legal obligations and protecting or enforcing legal rights. We may also retain your information in an anonymized form.  
  • Data portability. In some circumstances, you have the right to request that we provide you with the personal information which you have provided to us, so you can transfer this information to another data controller. Should you wish to do that, please contact us at info@justacorpse.com.  
  • Restriction of processing. In some cases, you may have the right to request a restriction of the processing of your personal information. 
  • Right to file a complaint. You have the right to file a complaint against us. To do so, contact the supervisory authority in your country of residence. 
 
  1. INTERNATIONAL TRANSFER
We operate globally, therefore subject to applicable law, information we obtain from or about users may be processed or transferred to data centers located throughout the world. The standards and laws that apply to the protection of personal data in such countries may be different from that which is afforded in your own country.   Just A Corpse will transfer your personal information only when the transfer is based on one of the following safeguards:  
  • To a country with adequate data protection: We will transfer your personal information outside EEA to a country that ensures an adequate level of protection pursuant to EEA data protection legislation. 
  • Based on approved certification mechanism: We will transfer your personal information to our partner outside EEA if our partner is certified under an approved certification mechanism pursuant to EEA data protection legislation.  
  •  Based on standard contractual clauses: We will transfer your personal information to our partner outside EEA, if we entered with our partner into standard contractual clauses, adopted by the European Commission pursuant to EEA data protection legislation and are deemed to offer adequate safeguards with respect to the protection of the privacy and fundamental rights and freedoms of individuals.

You can direct any questions or complaints about the use or disclosure of your personal information to us at info@justacorpse.com. We will investigate and attempt to resolve any complaints or disputes regarding the use or disclosure of personal information within 45 days of receiving your complaint.

This policy may change from time to time and we will post the amended terms and notify you by email in the event of substantial changes. You should review the Privacy Policy periodically to remain informed of any changes. You agree to accept posting of a revised Privacy Policy as actual notice to you. Your continued use of the Online Store following any changes to this Privacy Policy have been posted as of the “Last Updated” date below (or, if applicable, notified) signifies your acceptance of those changes. If you do not agree to the revised Privacy Policy, please refrain from using our Online Store.
